New Level 3 School Fees Status Memo and Protest Letter

An important message from the CBIA Legal Team

To All BIA Builder Member:

Now that the voters have approved the Prop 51 school bond, our attorneys (Dave Lanferman and Matt Francois) have prepared an updated form letter of protest for you to use if you are facing a school district attempting to impose Level 3 fees (below).  We have also updated the memo explaining the letter of protest as background for you. 

The protest now includes an objection that the notice to the clerks of both the Senate and the Assembly has not been printed in the journals – a necessary prerequisite for school districts to charge Level 3 fees.  In addition, the protest notes the passage of Proposition 51 indicated that funds are available – removing a necessary prerequisite for imposing Level 3 fees.
